File application to Vary, Extend, Revoke, Breach or Vary without Notice

This Quick Reference Guide shows how to file an application to Vary, Extend, Revoke, Breach or Vary without Notice.

 

1. From CMS Portal Home page, click: File on One of My Cases. List of cases display.

 

Note: Only cases user previously filed on or requested access to, display.

2. For relevant case, click: File a Subcase. Add Subcase screen displays.

3. To identify filing, type reference in My Reference field.

4. Complete required panels and fields.

 

Panel:  Subcase Information

  • Filing Type: -
  • Sub Case Type: Select either:
    • Vary
    • Extend
    • Revoke
    • Breach
    • Vary without notice

 

5. Complete required panels and fields for selected subcas type.

 

Vary

  • Related Orders: Select relevant order(s).
  • Code/Name: -
  • Grounds for Application: Type grounds.
  • Variation Sought:
    • Type variation sought
    • Note: Not required if filing variation on Interim Accommodation Order
  • Filed By: Select filing party or type name in Add Filed By panel.
  • Representation:
    • Select filing party's legal representation if applicable.
    • To add representation, click: Add Representation
  • Applies To: Select party(s).
  • Add to Related Cases: Add to related case(s).

 

Extend

  • Related Orders: Select relevant order(s).
  • Code/Name: -
  • Grounds for Application: Type details.
  • Either:
    • Extension Period (in months): Type number of months, OR
    • Extension Date: Type or use calendar icon to select date
  • Filed By: Select filing practitioner or type name in Add Filed By panel.
  • Applies To: Select party(s).
  • Add to Related Cases: Add to related case(s).

 

Revoke

  • Related Orders: Select relevant order(s)
  • Code/Name: -
  • Grounds for Application: Type grounds.
  • Has Leave of the Court been applied for?
    • Select Yes or No
    • Note: Displays if Long-Term Care order is selected as related order.
  • Filed By: Select filing party or type name in Add Filed By panel.
  • Representation:
    • Select filing party's legal representation if applicable.
    • To add representation, click: Add Representation
  • Applies To: Select party(s).
  • Add to Related Cases: Add to related case(s).

 

Breach

 

  • Code/Name: -
  • Is this application by Emergency Care?
    • Select Yes or No
    • Note: If Yes, upload required document.
  • Reason for service of this notice: Select relevant option.
  • Set out relevant details: Type details of breach.
  • Filed By: Select filing practitioner or type name in Add Filed By panel.
  • Applies To: Select party(s).
  • Add to Related Cases: Add to related case(s).

 

Vary without notice

  • Related Orders: Select either:
    • Family Reunification Order
    • Temporary Assessment Order
  • Code/Name: -
  • Grounds for Application: Type grounds.
  • Variation Sought: Type variation sought
  • Filed By: Select filing practitioner or type name in Add Filed By panel.
  • Representation:
    • Select filing party's legal representation if applicable.
    • To add representation, click: Add Representation
  • Applies To: Select party(s).
  • Add to Related Cases: Add to related case(s).

 

6. Is Add New Hearing correct option?

  • Yes: Go to next step.
  • No: Go to step 7.

 

7. Complete required panels and fields.

 

Panel:  Add Hearing

  • Add New Hearing:
    • Select: Add New Hearing.
    • Select relevant option from Calendar Assistant.
  • Event Location: Change if required.
  • Hearing Type: -
  • Date & Time: Do not change.
  • Duration: Do not change.
  • Resources: Select if required.
  • Interpreter:
    • Select party requiring interpreter.
    • Note: If additional party(s) require interpreter, click: + Interpreter.
  • Duration: Type interpreter booking duration.
  • Interpreter Language: Select required interpreter language.
  • Is gender specific interpreter required?
    • Select Yes or No.
    • Note: If Yes, select gender.
  • Hearing Notes: Type if required.

 

8. Is List with Existing Hearing correct option?

  • Yes: Go to next step.
  • No: Go to step 11.

 

9. In Add Hearing panel, select: List with Existing Hearing. Related Hearings panel displays.

10. Complete required panels and fields.

 

Panel:  Add Hearing

  • Related Hearings: Select hearing to list with.
  • Resources: Select if required.
  • Interpreter:
    • Select party requiring interpreter.
    • Note: If additional party(s) require interpreter, click: + Interpreter
  • Duration: Type interpreter booking duration.
  • Interpreter Language: Select required interpreter language.
  • Is gender specific interpreter required?
    • Select Yes or No.
    • Note: If Yes, select gender.
  • Hearing Notes: Type if required.

 

11. Complete required panels and fields.

 

Panel:  Additional Documents

  • Code/Name: Type name and select additional document(s).
  • Upload Document:
    • Select:  Attach File.
    • Click:  Choose File and attach PDF document.  

 

12. Select Electronic Signature Consent to consent to affixing your signature to filing.

13. Click: Proceed. Confirmation of Filing screen displays.

 

Note: Document is generated and can be accessed through My Account screen.
