File Costs Order (draft order)

This Quick Reference Guide shows how file a Cost Order (draft order).
File order on substantive subcase
1. From CMS Portal Home page, click: File on One of My Cases. List of cases display.
Note: Only cases user previously filed on or requested access to, display.

2. For relevant case, click case number link. Filings tab displays.
3. Click Hearings tab. Hearings tab displays.
4. For relevant hearing, click: Add Draft Order. Add Draft Order screen displays.
5. To identify filing, type reference in My Reference field.
6. Complete required panels and fields.
Order Panels
- Consent Type: Select relevant option.
- Hearing Notations: Type if required.
- Sub-cases: Select relevant subcase.
- Add Order(s): Select: Costs Order.
7. Click plus icon. Costs Order panel displays.
8. Complete required panels and fields.
Panel: Cost Order
- Party to Pay:
- Select relevant option.
- Note:
- If Enter individual party selected, type name of party in Party Name field.
- If Solicitor Firm, click Solicitor Firm panel and type solicitor name.
- On Behalf Of:
- Select relevant option
- Note: Field displays if Victoria Legal Aid or Solicitor firm selected in Party to Pay field.
- Party to Receive:
- Select relevant option.
- Note:
- If Enter individual party selected, type name of party in Party Name field.
- If Solicitor Firm, click Solicitor Firm panel and type solicitor name.
- For the legal representation of:
- Select relevant option.
- Note: Field displays if Victoria Legal Aid or Solicitor firm selected in Party to Receive field.
- Total Cost $: Type amount.
- Months:
- Either complete Months or End Date field.
- Type number of months in Months field.
- End Date:
- Either complete Months or End Date field.
- Type in End Date field or click Calendar icon to select date.
- Costs Reserved:
- Select if required.
- Note: If Costs Reserved selected, Months and End Date fields are not required.
- Further Order: Type if required.
9. Click: Add Order. Order Summary displays.
Note:
- Once all orders are added, click Preview button to review order in more detail
- Protection application findings order must also be made

10. Is another order required?
- Yes:
- Add order.

- No: Go to next step
11. Is Order Summary correct?
- Yes: Go to next step
- No:
- Amend order

12. In Share with parties or submit to court? field, select relevant option.
Note:
- Share with Parties allows other parties to view and update Minutes of Proposed Orders
- Draft Order cannot be updated once Submit to Court selected
13. Click: Proceed. Confirmation of Filing screen displays.
Note:
- Draft Order can be updated in Orders tab any time before submission to Court
- Once submitted, Minutes of proposed orders document generates and can be accessed through My Account screen

File order on application for costs subcase
1. From CMS Portal Home page, click: File on One of My Cases. List of cases display.
Note: Only cases user previously filed on or requested access to, display.

2. For relevant case, click case number link. Filings tab displays.
3. Click Hearings tab. Hearings tab displays.
4. For relevant hearing, click: Add Draft Order. Add Draft Order screen displays.
5. To identify filing, type reference in My Reference field.
6. Complete required panels and fields.
Order Panels
- Consent Type: Select relevant option.
- Hearing Notations: Type if required.
- Sub-cases: Select relevant subcase.
- Add Order(s): Select: Application Order.
7. Click plus icon. Application Order panel displays.
8. Is order Granted?
- Yes:
- In Application Result field, select Granted
- Go to next step
- No:
- In Application Result field, select Refused, Dismissed or Struck Out
- Go to step 11
9. Click: Add Order. Cost Order panel displays.
10. Complete required panels and fields.
Panel: Cost Order
- Party to Pay:
- Select relevant option.
- Note:
- If Enter individual party selected, type name of party in Party Name field.
- If Solicitor Firm, click Solicitor Firm panel and type solicitor name.
- On Behalf Of:
- Select relevant option
- Note: Field displays if Victoria Legal Aid or Solicitor firm selected in Party to Pay field.
- Party to Receive:
- Select relevant option.
- Note:
- If Enter individual party selected, type name of party in Party Name field.
- If Solicitor Firm, click Solicitor Firm panel and type solicitor name.
- For the legal representation of:
- Select relevant option.
- Note: Field displays if Victoria Legal Aid or Solicitor firm selected in Party to Receive field.
- Total Cost $: Type amount.
- Months:
- Either complete Months or End Date field.
- Type number of months in Months field.
- End Date:
- Either complete Months or End Date field.
- Type in End Date field or click Calendar icon to select date.
- Costs Reserved:
- Select if required.
- Note: If Costs Reserved selected, Months and End Date fields are not required.
- Further Order: Type if required.
11. Click: Add Order. Order Summary displays.
Note: Once all orders are added, click Preview button to review order in more detail.
12. Is another order required?
- Yes:
- Add order.
