File Protection application by Emergency Care
1. From CMS Portal Home page, select: Children's Court of Victoria. Select a Case Type screen displays.
2. Select: Child Protection. Child Protection screen displays.
3. Select: File a Protection Application. Protection Application screen displays.
4. To identify filing, type reference in My Reference field.
5. Complete required panels and fields.
Panel: Filing Details
- Court Location: Select court location.
- Link to Existing Sibling Case(s): Select Yes or No. Note: If Yes, complete additional fields.
6. Click: Next Step. Applicant Details screen displays.
7. Complete required panels and fields.
Panel: Applicant Details
- Surname / Single Name: Type surname. Select correct option from results. Note: For Emergency Care applications, process may be completed by authorised portal user other than applicant in the proceeding.
8. Click: Next Step. Case Details screen displays.
9. Complete required panels and fields.
Panel: Case Details
- Child in Emergency Care? Select: Yes
- Grounds for Application: Select relevant ground(s). Note: Use multi-select tool to select multiple grounds.
Panel: Child Details
- Party Designation Type: Do not change.
- DFFH ID: Type DFFH Client or Person Identifier.
- Surname / Single Name: Type surname or single name.
- First Name: Type first name.
- Middle Name (s): Type middle name(s) if required.
- Date of Birth: Type date or click calendar icon to select date.
- Sex/Gender: Select relevant option.
- Identified term and/or pronouns: Type relevant terms or pronouns if required.
- Indigenous Status: Select relevant option.
- Is an interpreter required? Select Yes or No. Note: If Yes, complete additional fields.
Panel: Child's Home Address
- Address Type: Change if required.
- Address: Start typing address and select correct option from results. Note: If correct address does not display, manually enter in fields below.
- Is this a confidential address? Change if required.
Panel: Child's Placement Details
- Where is the child currently placed? Select relevant option.
Panel: Child's Custody Status
- Is the child currently in custody? Select Yes or No.
Panel: Parent 1 Details
- Relationship to Child: Select relevant option.
- Is the Parent Known? Change if required.
- Party Designation Type: Do not change.
- DFFH ID: Type DFFH Client or Person Identifier.
- Surname / Single Name: Type surname or single namFirst Name: Type first name.
- Middle Name (s): Type middle name(s) if required.
- Date of Birth: Type date or click calendar icon to select date.
- Sex/Gender: Select relevant option.
- Identified term and/or pronouns: Type relevant terms or pronouns if required.
- Indigenous Status: Select relevant option.
- Is an interpreter required? Select Yes or No. Note: If Yes, complete additional fields.
- Mobile Number: Type mobile number if provided.
- Home Number: Type home number if provided.
- Work Number: Type work number if provided.
- Email Address: Type email address if provided.
- Address Type: Change if required.
- Physical Address: Start typing address and select correct option from results. Note: If correct address does not display, manually enter in fields below.
- Is this a confidential address? Change if required.
10. Complete Parent 2 Details panel.
11. Complete required panels and fields.
Panel: Document Details
- Protection Application: -
- Code / Name: -
- Upload Document:
- Click: Choose File.
- Attach Protection Application PDF document.
Panel: Additional Documents
- Code / Name: Type name and select additional document(s)
- Upload Document: Click: Choose File and upload PDF document.
12. Are additional parties required?
- Yes: Go to next step.
- No: Go to step 14.
13. Complete required panels and fields.
Panel: Additional Party Details
- Party Role in Application: Select Parent or Other.
- Relationship to Child: Select relationship. Note:
- Options available change based on Party Role in Application selection.
- If Other and Other Relative selected, additional field Relationship to Child Description displays.
- Complete additional fields to input party details.
Note: Click + Additional Party Details to add further additional party(s).
14. Complete required panels and fields.
Panel: Related Intervention Order Proceedings (1)
- Are there any related intervention order proceedings? Select Yes or No. Note:
- If Yes, free text fields display to provide Case Number and Party Details information.
- Click (+) Related Intervention Order Proceedings to add additional intervention order proceedings.
15. Does sibling need to be added to this application?
- Yes: Click: (+) Add Siblings. Note:
- Case Details panel is duplicated.
- Repeat process for each additional sibling.
- No: Go to next step
16. Click: Next Step. Hearing Details screen displays.
17. Complete required panels and fields.
Panel: Hearing Details
- Add New Hearing: Select: Add New Hearing. Select relevant option from Calendar Assistant.
- Court Location: -
- Hearing Type: -
- Duration: Do not change.
Panel: Additional Panels
- Resources: Select if required.
- Hearing Notes: Type if required.
18. Click: Proceed. Confirmation of Filing screen displays.
Note:
- Case is listed for hearing.
- CMS sends automatic referral to Victoria Legal Aid for lawyers to be allocated to party(s).
- Ensure Child Protection Litigation Office is advised of listing.
- Affidavit of Service, Form B and CRIS notes should be uploaded prior to hearing.

8. Click: Next Step. Case Details screen displays.

- Child in Emergency Care? Select: No
- Grounds for Application: Select relevant ground(s). Note: Use multi-select tool to select multiple grounds.

- Date of Death field displays
- Contact Details, Address and Custody panels do not display
- Party Designation Type: Do not change.
- DFFH ID: Type DFFH Client or Person Identifier.
- Surname / Single Name: Type surname or single namFirst Name: Type first name.
- Middle Name (s): Type middle name(s) if required.
- Date of Birth: Type date or click calendar icon to select date.
- Sex/Gender: Select relevant option.
- Identified term and/or pronouns: Type relevant terms or pronouns if required.

- Protection Application: - . Note: Document is electronically generated upon filing of Protection Application in CMS Portal.
Panel: Additional Documents
- Code / Name: Type name and select additional document(s).
- Upload Document: Click: Choose File and upload PDF document.
12. Are additional parties required?
- Yes: Go to next step.
- No: Go to step 14.
13. Complete required panels and fields.
Panel: Additional Party Details
- Party Role in Application: Select Parent or Other.
- Relationship to Child: Select relationship. Note:
- Options available change based on Party Role in Application selection.
- If Other and Other Relative selected, additional field Relationship to Child Description displays.
- Complete additional fields to input party details.
Note: Click + Additional Party Details to add further additional party(s).
14. Complete required panels and fields.

- Protection Application is generated by CMS Portal and can be downloaded for service on party(s).
- CMS sends automatic referral to Victoria Legal Aid for lawyers to be allocated to party(s).
- Ensure Child Protection Litigation Office is advised of listing.
- Affidavit of Service and Court Report should be uploaded prior to hearing.
