File Transfer of Child Protection Order

This Quick Reference Guide shows how to file a Transfer of Child Protection Order in CMS Portal.

 

Note: As this guide only references how to file a Transfer of a Child Protection order, please contact the Melbourne Children's Court Registry for procedural advice regarding the registration of interim proceeding prior to commencing filing interim proceedings via the portal.

 

1. From CMS Portal Home page, click: Children's Court of Victoria. Select a Case Type screen displays.

2. Click: Child Protection

3. Click: File Other Application. Child Protection - Other Applications screen displays.

4. To identify filing, type reference in My Reference field.

5. Complete required panels and fields.

 

Panel:  Filing Details

  • Court Location: Select Melbourne.
  • Application Type:  Select: Registration of Interstate Child Protection Order or Proceeding
  • Link to Existing Sibling Case(s): Change if required. Note: If Yes, complete additional fields.

 

6. Click Next Step or alternatively click the green buttons to navigate between steps at any time.

7. Complete required panels and fields.

 

Panel:  Applicant Details

  • Surname/ Single Name: Type surname. Select correct option from results. Note: Document can only be filed by the child protection practitioner filing the document, as this generates the notice.

 

8. Click: Next Step

9. Complete required panels and fields.

 

Panel:  Child's Details

  • Party Designation Type: Do not change.
  • DFFH ID: Type DFFH Client ID or person identifier.
  • Surname / Single Name: Type surname or single name.
  • First Name: Type first name
  • Middle Name (s): Type middle name(s) if required.
  • Date Of Birth: Type date or click calendar icon to select date.
  • Sex/Gender: Select relevant option
  • Identified term and/or pronouns: Type additional details if required.
  • Indigenous Status: Select Indigenous status.
  • Is an interpreter required? Select Yes or No. Note: If Yes, complete additional fields.

 

Panel:  Child's Home Address

  • Address Type: Do not change.
  • Address: Start typing address and select correct option from results. Select correct option from results. Note: If correct address does not appear, manually enter in fields below.
  • Are these address / contact details confidential? Change if required.

 

10. Click: Next Step

11. Complete required panels and fields.

 

Panel:  Details of Application

  • Originating Court: Start typing of originating court and select correct option from results.
  • Original Case Number: Type original Case Number.
  • Interstate Order Type: Type Order type to be registered.
  • Date Interstate Order/Decision was made: Type date or click calendar icon to select date.
  • What is the expiry date of the order? Type date or click calendar icon to select date.
  • At the time of making this application, the matter is not subject to an appeal or a review, and the time for seeking an appeal or review has expired: Check box to confirm matter is not subject to an appeal or review at time of filing.

 

12. Click:  Next Step

13. Complete required panels and fields.

 

Panel:  Party Details (1)

  • Party Role in Application: Change if required.
  • Is the Party Known? Change if required. Note: If parent is Unknown, subsequent Parent Details panels do not display. If the parent is Deceased the Date of Death field displays. Further to this the Contact Details, Address and Custody panels do not display.
  • DFFH ID: Type DFFH Client ID or person identifier
  • Party Designation Type: Do not change.

 

  • Surname / Single Name: Type surname or single name.
  • First Name: Type first name
  • Middle Name (s): Type middle name(s) if required.
  • Date Of Birth: Type date or click calendar icon to select date.
  • Sex/Gender: Select relevant option
  • Identified term and/or pronouns: Type additional details if required.
  • Indigenous Status: Select Indigenous status.

 

  • Is an interpreter required? Select Yes or No. Note: If Yes, complete additional fields.
  • Address Type: Do not change.
  • Physical Address: Start typing address and select correct option from results. Note: If correct option foes not appear, manually enter address in fields below.
  • Are these address / contact details confidential? Change if required.
  • Mobile Number: Type mobile number if required.
  • Home Number: Type home number if required.
  • Work Number: Type work number if required.
  • Email Address: Type email address if required.

 

14. Complete Parent 2 Details panel.

15. Click:  Next Step

16. Complete required panels and fields for Document Details.

17. Click: Proceed. The confirmation of filing screen.

 

Note: The application is placed in work queue for registry to review. The document status displays as Pending Review and is updated once work queue is actioned by the registry.

 

Once processed, a sealed copy of the Filing of order or decision to transfer an interstate child protection order to Victoria for registration and the Court Order will be available for download on the CMS portal.
